The main argument against Proposition 8 is that it &lt;span style="font-style: italic;"&gt;"would eliminate fundamental rights for a group of Californians."&lt;/span&gt; The purpose of this article is to point out the fact that State-sanctioned marriage is not a "right" to be found in the U.S. or the California constitutions. The definition of it is &lt;span style="font-style: italic;"&gt;only &lt;/span&gt;something that we agree upon as a society, not something that we have forced upon us by a noisy minority or a handful of judges. Either the opponents of Prop. 8 are naive enough to believe they have the power to bestow "fundamental rights" upon whomever &lt;span class="blsp-spelling-error" id="SPELLING_ERROR_0"&gt;they&lt;/span&gt; wish or they understand that the &lt;span style="font-style: italic;"&gt;right &lt;/span&gt;to marriage does not exist and they're intentionally misleading voters. All I'm asking for is a little bit of intellectual honesty in our argument here. That's all.&lt;br /&gt;&lt;br /&gt;So where do the opponents of Prop. 8 and the California Supreme Court think they see the right to state-sanctioned marriage in our constitution? Don't tell me that we all have the right to pursue "happiness". That argument is nonsense. It makes some people "happy" to have more than one wife at a time, yet we're perfectly happy to restrict marriage from that. We the people have the right to decide on the laws under which we chose to live and thus have the right to define marriage any way we want to define it.&lt;br /&gt;&lt;br /&gt;The original protection of marriage act, Proposition 22, was passed by the voters of the state of California in the 2000 election. The language was exactly the same as the language used for Proposition 8, "&lt;i&gt;Only marriage between a man and a woman is valid or recognized in California.&lt;/i&gt;" The original Prop. 22, which was struck down by the California Supreme Court by a vote of 4-3 on May 14, 2008, was deemed unconstitutional - by FOUR people! - because these FOUR people think that the equal protection clause of the California Constitution was violated (I stress the language "four &lt;span style="font-style: italic;"&gt;people&lt;/span&gt;" simply because, whether these people have a title or not, they're still simply people, citizens of the State of California, just like you and me, and many of us are equally capable of interpreting the language of a document). Let's examine:&lt;br /&gt;&lt;br /&gt;Prop. 22: "&lt;span style="font-style: italic;"&gt;Only marriage between a man and a woman is valid or recognized in California.&lt;/span&gt;"&lt;br /&gt;&lt;br /&gt;Article 1, Section 3.4 CA State Constitution: "&lt;span style="font-style: italic;"&gt;Nothing in this subdivision supersedes or modifies any provision of this Constitution, including the guarantees that a person may not be deprived of life, liberty, or property without due process of law, or denied equal protection of the laws, as provided in Section 7.&lt;/span&gt;"&lt;br /&gt;&lt;br /&gt;I don't know how this can be interpreted any other way - unless your personal biases cause you to see what you want to see. Prop. 22 became California law in 2000 as a result of a legitimate vote by the citizens of the state. The US and CA constitutions simply state that all citizens are entitled to equal protection under the law. Prop. 22 treats every citizen of California in &lt;span style="font-style: italic;"&gt;exactly &lt;/span&gt;the same manner. Every man is treated equally and every woman is treated equally under this law. &lt;span style="font-style: italic;"&gt;None &lt;/span&gt;of us is allowed to marry anyone else of the same sex. Every single citizen of the state must follow the same rule. Therefore, the law clearly does not discriminate against any person.  A heterosexual man cannot marry another man any more than a homosexual man can and a heterosexual woman cannot marry another woman any more than a homosexual woman can.&lt;br /&gt;&lt;br /&gt;Now, if the law's language was, for example, &lt;span style="font-style: italic;"&gt;"Only marriage between two people who are in love with each other is valid or recognized in California, unless the people in question are homosexual."&lt;/span&gt;, then you could correctly argue that the statute is discriminatory. This law would be unconstitutional because it would not allow any homosexual person to be married to &lt;span style="font-style: italic;"&gt;anyone &lt;/span&gt;else - not someone of the opposite sex and same sexual orientation, nor someone of the same sex and sexual orientation, nor opposite sex and opposite sexual orientation. This law would discriminate between a heterosexual and a homosexual and treat the two differently under the law. However, under the law established by Prop. 22 and Prop. 8 (if it passes) a hetero or homosexual man will be allowed to marry a hetero or &lt;span class="blsp-spelling-corrected" id="SPELLING_ERROR_1"&gt;homosexual&lt;/span&gt; woman and vice &lt;span class="blsp-spelling-error" id="SPELLING_ERROR_2"&gt;versa&lt;/span&gt;. So under the proposed law, the state does not make any differentiation between hetero and homosexual people and therefore cannot be accused of being discriminatory and/or unconstitutional.&lt;br /&gt;&lt;br /&gt;If the majority of the citizens of California wants to change the definition of marriage in this election, then so be it. But don't tell me that if I vote 'yes' on Prop. 8 that I'm taking "fundamental rights" away from anybody. And I must say, I’m a bit disappointed yet not the least bit surprised. It seems that they think that a Segway, when not manned, is more of a safety hazard than a wheelchair. Please will you tell me please, have any injuries ever been reported that were caused by an unmanned Segway?&lt;br /&gt;&lt;br /&gt;I must say though, that the hand-written response was a nice touch. Plus, the handwriting was magnificent.&lt;br /&gt;&lt;br /&gt;“Dear John,&lt;br /&gt;&lt;br /&gt;Thank you for contacting me regarding the use of Segways on Amtrak. Please find the response from Amtrak’s Office of Government Affairs enclosed. Amtrak has run their guidelines through the U.S. Department of Transportation’s operating administration for guidance and views it as a safety risk to transport the Segway. Although Amtrak will re-visit its policy on Segways, Amtrak has said that for now, this response is the final position.&lt;br /&gt;&lt;br /&gt;Please feel free to call me should you require further information. I will communicate any updates regarding this policy as they become known. Thank you again for contacting me.&lt;br /&gt;&lt;br /&gt;Sincerely,&lt;br /&gt;Joseph I. Lieberman&lt;br /&gt;United States Senator”&lt;br /&gt;&lt;br /&gt;Attached was the following response, originally written in response to somebody else’s similar claim, on 3/12/2007.&lt;br /&gt;&lt;br /&gt;“Amtrak’s policy on Segways apparently was developed several years ago. Since that time, Amtrak has become aware that, although the manufacturer does not advertise its equipment as an aid for persons with mobility impairments, Amtrak is aware that an increasing number of persons with mobility impairments are beginning to make use of Segways. Amtrak is also aware of the U.S DOT guidance on this issue. Although Amtrak will re-visit its policy on Segways, Amtrak’s current policy requires that Segways be treated as checked baggage. That is because Amtrak trains have no closet or other storage place enough to store safely the large, heavy Segway machines in the passenger compartments of Amtrak trains. Even if, as your consituent seems to suggest, a Segway could be safely parked in the space reserved for passengers using wheelchairs. Segway users do not remain on their Segways during hours-long Amtrak’s intercity rail passenger trips. Thus, the Segway user would be occupying who revenue-producing passenger spaces on board the train. Unfortunately, not all Amtrak trains are equipped with baggage cars. However, at many rail stations Amtrak can assist persons with mobility impairments by wheelchair. I realize that this response is not the one that your constituent would like to receive. However, Amtrak must be guided first and foremost by safety considerations. While I can not give you a time frame as to when our review will be completed, I will be staying in touch with Amtrak officials who are going to revisit this issue and will keep you posted.”&lt;br /&gt;&lt;br /&gt;Below, was a hand-written note from the woman who handled this case.&lt;br /&gt;&lt;br /&gt;“John, above was response in 3/07 from the Amtrak Director of Government Affairs regarding a similar issue by another CT constituent. I checked with the Senator’s aide in DC who handles transportation issues and she said that there is nothing new. However, she will mention your inquiry to the Amtrak representative when she sees her again. Please feel free to call me if needed. &lt;/span&gt;Their study was based on data from &lt;?xml:namespace prefix = st1 /&gt;&lt;st1:place st="on"&gt;&lt;st1:placename st="on"&gt;National&lt;/st1:placename&gt; &lt;st1:placetype st="on"&gt;Center&lt;/st1:placetype&gt;&lt;/st1:place&gt; for Health Statistics and U.S. Census Bureau [2,3].&lt;span style="font-size:+0;"&gt; &lt;/span&gt;In 2003, 44,757 people perished in car accidents, 48,071 in all transportation accidents.&lt;span style="font-size:+0;"&gt; &lt;/span&gt;19,457 people died as a result of “accidental poisoning by and exposure to noxious substances” and 17,229 people died from falling, while only 11,920 people met their demise by being shot with a gun.&lt;span style="font-size:+0;"&gt; &lt;/span&gt;In their study, the NSC found that the average American was over 4 times more likely to die in a transport accident than assault by firearm.&lt;span style="font-size:+0;"&gt; &lt;/span&gt;The average American is about 63 % more likely to be accidentally poisoned to death and 44 % more likely to fall to their deaths than to be assaulted and killed with a firearm.&lt;span style="font-size:+0;"&gt; &lt;/span&gt;Therefore, I propose that we put a ban on all automobiles, poisons (i.e. household cleaners – especially bleach, that one’s a doozy), and heights (i.e. stairs, tall buildings, cliffs – especially cliffs).&lt;span style="font-size:+0;"&gt; &lt;/span&gt;I don’t like cleaning or heights much anyway.&lt;span style="font-size:+0;"&gt; &lt;/span&gt;How does that sound?&lt;/p&gt;&lt;p class="MsoNormal"&gt;I have yet to hear of a single case in which a gun jumped up off a table, pulled its own trigger, and killed somebody.&lt;span style="font-size:+0;"&gt; and the new strategy to be implemented in that troubled country. I am not a military expert. I don’t know if the proposed increase in troops and new plan will lead to success and thus allow the &lt;st1:country-region st="on"&gt;&lt;st1:place st="on"&gt;U.S.&lt;/st1:place&gt;&lt;/st1:country-region&gt; military to return home. As such I would never presume to know for certain what is best for our country in the long run when it comes to this scenario and I certainly did not sit down tonight to write an argument for the President’s decision nor for troop withdrawal. What I did sit down to discuss is the disillusionment I felt upon listening to the Democrat response to the President’s speech along with the consistent “it’s time to leave Iraq” mantra of the party leading up to and following the November 2006 elections.    &lt;p class="MsoNormal"&gt;I should be upfront and inform the reader as to my personal political persuasion. If it has not already been made obvious let me leave no doubt that I am a conservative mind. Consequently, I undoubtedly bring a bias to the discussion that is difficult for me to gauge, despite my human nature that insists I am capable of achieving an objective viewpoint. But upon watching the Democratic response to the President’s speech by Senator Dick &lt;span class="blsp-spelling-error" id="SPELLING_ERROR_0"&gt;Durbin&lt;/span&gt; I was not surprised to hear that the party’s position is still that it’s time for the Iraqi government to suck it up and for us to pack it up. This, I must admit, is quite an enticing position, not only for me, but for any American who hates to see American soldiers fall in the line of duty. As much as my moral compass insists that the lives and freedom of the Iraqi people are worth fighting and dying for, I am tempted to agree with the senator from &lt;st1:state st="on"&gt;&lt;st1:place st="on"&gt;Illinois&lt;/st1:place&gt;&lt;/st1:State&gt; and I must admit, part of me says they’re not. It is exactly this sentiment that won the Democrats control of both Houses of Congress and lost it for the Republicans last November – a position rarely disputed among political pundits – despite that fact that the party almost unanimously supported the war in its early stages (i.e. when it was popular). Upon agreeing with the President tonight on CNN Senator John McCain, Larry King asked McCain if he had considered the political implications of his position, especially considering the fact that many Republicans are now at odds with the President’s point of view. The Senator answered, “I would much rather loose and election than loose a war.” I was actually surprised to hear such strong words from a man who many consider to be the Republican &lt;span class="blsp-spelling-error" id="SPELLING_ERROR_1"&gt;frontrunner&lt;/span&gt; in the 2008 Presidential elections. McCain’s words sound to me to be absent of any political calculation. And therein lies my disillusionment with the Democratic Party. So I sincerely ask the reader, am I wrong to suspect that the current Democratic position on Iraq is not only the easy way out, but also the politically popular position that they believe will catapult their party to Presidential victory in 2008? Standing on the sidewalk. Minding my own business. I believe that it still holds true.&lt;br /&gt;&lt;br /&gt;&lt;p class="MsoNormal" style="line-height: 200%;"&gt;&lt;span style="line-height: 200%;font-size:12;" &gt;Throughout history all major civilizations have used some form of punishment for lawbreakers.&lt;span style=""&gt;  &lt;/span&gt;The most common is incarceration.&lt;span style=""&gt;  &lt;/span&gt;An individual would be isolated from his/her community as punishment for a crime.&lt;span style=""&gt;  &lt;/span&gt;These individuals were also looked down upon by society.&lt;span style=""&gt;  &lt;/span&gt;They were branded as the lowest of the low; individuals to be regarded as animals.&lt;span style=""&gt;  &lt;/span&gt;In today’s American society there are sub-cultures that use these individuals as role models.&lt;span style=""&gt;  &lt;/span&gt;For some, surviving a prison sentence is a right of passage.&lt;span style=""&gt;  &lt;/span&gt;An ex-convict is thought to be “cool” or a “man”.&lt;span style=""&gt;  &lt;/span&gt;It is typically the largest group in our society, the lower class, who views these individuals with respect.&lt;span style=""&gt;  &lt;/span&gt;Youth of this group often choose to emulate a brother, uncle or cousin who has served in prison.&lt;span style=""&gt;  &lt;/span&gt;Prison is no longer a deterrent. After the &lt;/span&gt;&lt;st1:country-region&gt;&lt;st1:place&gt;&lt;span style="line-height: 200%;font-size:12;" &gt;Vietnam&lt;/span&gt;&lt;/st1:place&gt;&lt;/st1:country-region&gt;&lt;span style="line-height: 200%;font-size:12;" &gt; era, law enforcement has been viewed with disgust; a new deterrent must be found, be it lethal consequences or merely toughening our prisons.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal" style="line-height: 200%;"&gt;&lt;span style="line-height: 200%;font-size:12;" &gt;&lt;span style=""&gt;            &lt;/span&gt;During the Vietnam War, Americans began to view law enforcement as vile. No longer were they heroes or role models.&lt;span style=""&gt;  &lt;/span&gt;They were seen as no better then thugs.&lt;span style=""&gt;  &lt;/span&gt;This view has been passed on from the individuals growing up at the time to the current youth, their children and grandchildren.&lt;span style=""&gt;  &lt;/span&gt;This view also caused it to be unpopular to be a police officer and so in some cases the quality of officers has diminished.&lt;span style=""&gt;  &lt;/span&gt;Many retired police officers view the current law enforcement as children. Not because of age, but because of the maturity and quality they possess.&lt;span style=""&gt;  &lt;/span&gt;Not only did the &lt;/span&gt;&lt;st1:country-region&gt;&lt;st1:place&gt;&lt;span style="line-height: 200%;font-size:12;" &gt;Vietnam&lt;/span&gt;&lt;/st1:place&gt;&lt;/st1:country-region&gt;&lt;span style="line-height: 200%;font-size:12;" &gt; era perpetuate this “fight ‘the man’” philosophy it promoted seeking a &lt;/span&gt;&lt;st1:state&gt;&lt;st1:place&gt;&lt;span style="line-height: 200%;font-size:12;" &gt;free state&lt;/span&gt;&lt;/st1:place&gt;&lt;/st1:state&gt;&lt;span style="line-height: 200%;font-size:12;" &gt; of mind; be free of rules, free of laws, free to indulge.&lt;span style=""&gt;  &lt;/span&gt;These ideas have slowly seeped into our society along with the “accept everyone” and “it’s okay, it’s not their fault” ideals.&lt;span style=""&gt;  &lt;/span&gt;In today’s society police officers are still looked down upon and criminals are being looked up to.&lt;span style=""&gt;  &lt;/span&gt;Youth feel they need to avoid the police and that laws must be disobeyed.&lt;span style=""&gt;  &lt;/span&gt;Not that it’s okay to break them it is the “right” thing to do.&lt;span style=""&gt;  &lt;/span&gt;These ideals must be corrected.&lt;span style=""&gt;  &lt;/span&gt;Correctional officers will agree that prison does not work. They see the same criminals repeatedly, and new ones everyday.&lt;span style=""&gt;  &lt;/span&gt;A &lt;/span&gt;&lt;st1:place&gt;&lt;span style="line-height: 200%;font-size:12;" &gt;Riverside&lt;/span&gt;&lt;/st1:place&gt;&lt;span style="line-height: 200%;font-size:12;" &gt; county employee noted that &lt;/span&gt;&lt;st1:place&gt;&lt;span style="line-height: 200%;font-size:12;" &gt;Riverside&lt;/span&gt;&lt;/st1:place&gt;&lt;span style="line-height: 200%;font-size:12;" &gt; county central jail processes approximately five thousand prisoners a month.&lt;span style=""&gt;  &lt;/span&gt;Jail time is no longer a viable means of deterrent.&lt;span style=""&gt;  &lt;/span&gt;We must change the current system or expand capital punishment.&lt;span style=""&gt;  &lt;/span&gt;The only option left would be a more effective means of punishment, like execution.&lt;span style=""&gt;  &lt;/span&gt;&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal" style="line-height: 200%;"&gt;&lt;span style="line-height: 200%;font-size:12;" &gt;&lt;span style=""&gt;            &lt;/span&gt;First, expanding lethal consequences would act as a greater deterrent than prison.&lt;span style=""&gt;  &lt;/span&gt;Enacting a bounty on individuals such as gang members would dramatically cut the amount of gang activity.&lt;span style=""&gt;  &lt;/span&gt;The ethics of such a system will be questioned but is it ethical to let such individuals victimize the general populace.&lt;span style=""&gt;  &lt;/span&gt;Some psychologists agree that this personality type will only respond to a “violent” punishment, something prison is not.&lt;span style=""&gt;  &lt;/span&gt;The justice system must “speak their language”(Barbara Bertrand, interview).&lt;span style=""&gt;  &lt;/span&gt;Many of today’s youth have grown up surrounded by these individuals and would agree with this system. The ideals of our parents do not work. The system would be strictly regulated.&lt;span style=""&gt;  &lt;/span&gt;To qualify to be on a bounty sheet the individual would have to be a repeat offender with a minimum number of convictions.&lt;span style=""&gt;  &lt;/span&gt;The amount of bounty would be decided be number of total convictions and rank of that individual within the gang.&lt;span style=""&gt;  &lt;/span&gt;The bounty hunters would then have to take an accepted course in firearms training to avoid the injuring of non-targets.&lt;span style=""&gt;  &lt;/span&gt;They would have to be licensed in order to buy bounty sheets and hunt gang members.&lt;span style=""&gt;  &lt;/span&gt;They would have to renew their licenses every six months in order to maintain hunter standards.&lt;span style=""&gt;  &lt;/span&gt;In order to collect the bounty they would have to take the individual to a central location, for identification and execution.&lt;span style=""&gt;  &lt;/span&gt;With today’s capabilities regarding DNA testing and other forensic sciences no mistakes would be made.&lt;span style=""&gt;  &lt;/span&gt;To most, this would seem to be an immoral way to solve the problem.&lt;span style=""&gt;  &lt;/span&gt;No other methods seem to work. Training against gang involvement, education and teacher intervention, have proved futile. Crime rates are on the rise (CA DOJ, Adults Under State and Local Supervision).&lt;span style=""&gt;  &lt;/span&gt;Gangs continue to spread and take over more and more cities. For those against capital punishment, which is more immoral, removing a few useless individuals from society or allowing them to take over our streets and hurt innocents?&lt;span style=""&gt;  &lt;/span&gt;&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal" style="line-height: 200%;"&gt;&lt;span style="line-height: 200%;font-size:12;" &gt;&lt;span style=""&gt;            &lt;/span&gt;Others might argue about the fairness of such a bounty.&lt;span style=""&gt;  &lt;/span&gt;To make the bounty fair, those on the bounty sheets would have to opportunity to remove themselves.&lt;span style=""&gt;  &lt;/span&gt;They would have one year to remove all identifying marks, move at least five hundred miles from city of residence, abstain from all contact with former fellow gang members and hold a job for ten to twelve months.&lt;span style=""&gt;  &lt;/span&gt;Upon completion of these conditions; they would be removed from the bounty sheets.&lt;span style=""&gt;  &lt;/span&gt;A return to criminal behavior or failure to complete all requirements would result in an issuance of a permanent bounty sheet. No second chances would be given, no probation.&lt;span style=""&gt;  &lt;/span&gt;Another objection to this program would be funding. How would the bounties be paid? By having the hunters pay dues and “buy” bounty sheets funding could be accomplished with a minimum of government assistance.&lt;span style=""&gt;  &lt;/span&gt;To some individuals this program would still be unacceptable.&lt;span style=""&gt;  &lt;/span&gt;The final alternative is to modify the current systems.&lt;span style=""&gt;  &lt;/span&gt;Prisons are only a deterrent to those who couldn’t deal with the other prisoners. To people who frequent our prison system this is not a problem.&lt;span style=""&gt;  &lt;/span&gt;They deal with the same threats when in the general population.&lt;span style=""&gt;  &lt;/span&gt;The threats are not as condensed perhaps, but they remain.&lt;span style=""&gt;  &lt;/span&gt;Prison merely takes a criminal’s normal lifestyle and compresses it to the size of a few city blocks.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal" style="line-height: 200%;"&gt;&lt;span style="line-height: 200%;font-size:12;" &gt;&lt;span style=""&gt;            &lt;/span&gt;In prison an individual has three square meals a day, television, a library, schooling, weight lifting, a warm clean place to sleep and interaction with other humans.&lt;span style=""&gt;  &lt;/span&gt;Most honest individuals don’t have this amount of comfort.&lt;span style=""&gt;  &lt;/span&gt;The only threat to their safety or unpleasantness comes from other prisoners.&lt;span style=""&gt;  &lt;/span&gt;People aren’t afraid to be in jail, they are afraid to be surrounded by other prisoners.&lt;span style=""&gt;  &lt;/span&gt;The Discovery Channel had a special on prisons; one part was on the competitive weight lifting between prisoners.&lt;span style=""&gt;  &lt;/span&gt;The lead lifter could lift over six hundred pounds in a dead lift.&lt;span style=""&gt;  &lt;/span&gt;The individual was serving a sentence for robbery and rape.&lt;span style=""&gt;  &lt;/span&gt;It would be impossible for an average woman to fight off an attacker that can lift over six hundred pounds, a few times the body weight of the average woman (Discovery Channel, “Supermax“).&lt;span style=""&gt;  &lt;/span&gt;Instead of correcting criminal behavior the prison system is making it easier for them to commit crimes.&lt;span style=""&gt;  &lt;/span&gt;To toughen our prison system would involve several steps.&lt;span style=""&gt;  &lt;/span&gt;First instead of regular meals the prisoners would be served an oatmeal like substance with all the nutritional needs of the body.&lt;span style=""&gt;  &lt;/span&gt;The prisoners would be healthy but the food wouldn’t be pleasant, it should be bland and uneventful.&lt;span style=""&gt;  &lt;/span&gt;The next step would be to remove television and weight lifting.&lt;span style=""&gt;  &lt;/span&gt;Prisoners should not have a way to pass the time or get stronger.&lt;span style=""&gt;  &lt;/span&gt;Prison is meant to be unpleasant.&lt;span style=""&gt;  &lt;/span&gt;Prisoners should also be kept from forming groups inside prison.&lt;span style=""&gt;  &lt;/span&gt;Correctional facilities currently track groups/gangs inside prisons.&lt;span style=""&gt;  &lt;/span&gt;These records should be used to keep prisoners in the same group from socializing.&lt;span style=""&gt;  &lt;/span&gt;To further randomize socialization the prisoners should be rotated every six months to keep prisoners from forming bonds.&lt;span style=""&gt;  &lt;/span&gt;This would cut down on gang formations inside prison. For the final step to making our prison system unpleasant enough to deter furthers criminal acts.&lt;span style=""&gt;  &lt;/span&gt;The violent offender would be sent to a tent city in unpopulated areas.&lt;span style=""&gt;  &lt;/span&gt;A county in &lt;/span&gt;&lt;st1:state&gt;&lt;st1:place&gt;&lt;span style="line-height: 200%;font-size:12;" &gt;Arizona&lt;/span&gt;&lt;/st1:place&gt;&lt;/st1:state&gt;&lt;span style="line-height: 200%;font-size:12;" &gt; has adopted this and found it effective.&lt;span style=""&gt;  &lt;/span&gt;Making prisoners uncomfortable is the most effective way to keep them from returning.&lt;span style=""&gt;  &lt;/span&gt;No longer would prison emulate the criminals’ normal daily life it would be exceptionally unpleasant.&lt;span style=""&gt;  &lt;/span&gt;Their rights would not be violated. They would be healthy and taken care of.&lt;span style=""&gt;  &lt;/span&gt;The public would merely no longer go out of its way to make them comfortable.&lt;span style=""&gt;  &lt;/span&gt;Our prisons would also need less funding, there would be no television or expensive weight equipment to maintain of purchase, and food costs would be cut.&lt;span style=""&gt;  &lt;/span&gt;Chain gangs could also be used for ditch digging and road maintained etc.&lt;span style=""&gt;  &lt;/span&gt;Prisoners would be treated humanely and prisons would need less funding.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal" style="line-height: 200%;"&gt;&lt;span style="line-height: 200%;font-size:12;" &gt;&lt;span style=""&gt;            &lt;/span&gt;The &lt;/span&gt;&lt;st1:place&gt;&lt;span style="line-height: 200%;font-size:12;" &gt;Roman Empire&lt;/span&gt;&lt;/st1:place&gt;&lt;span style="line-height: 200%;font-size:12;" &gt;, The Byzantine Empire and The Greek city-states all fell because they accepted corruption and criminal behavior.&lt;span style=""&gt;  &lt;/span&gt;If the system is not changed, if we &lt;u&gt;accept&lt;/u&gt; this behavior, our society will crumble around us.&lt;span style=""&gt;  &lt;/span&gt;We must make the consequences unpleasant or lethal. &lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;    &lt;p class="MsoNormal" style="text-align: center; line-height: 200%;" align="center"&gt;&lt;b&gt;&lt;u&gt;&lt;span style="line-height: 200%;font-size:12;" &gt;Works Cited&lt;/span&gt;&lt;/u&gt;&lt;/b&gt;&lt;span style="line-height: 200%;font-size:12;" &gt;&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;    &lt;p class="MsoNormal" style="line-height: 200%;"&gt;&lt;u&gt;&lt;span style="line-height: 200%;font-size:12;" &gt;Supermax&lt;/span&gt;&lt;/u&gt;&lt;span style="line-height: 200%;font-size:12;" &gt;. I have to say I finally realized the error of my ways.  For a long time now I have preached against these religions who talk of Love, and Jesus and his sacrifice, and God with all his power and might.  But alas I too have had my vision and know what I must do.  I must encourage those who "believe" to spread the word and bring as many as possible into "the fold".  It brings me great happiness that all of God's children can be saved.  And that those who have heard the call, work tirelessly to do His work.  It brings me great hope to know that among the many sinners in the world today, there is noone who will be left out of the kingdom of heaven.  All they must do is give themselves freely to Jesus and have faith in their Lord, thy GOD.  My neighbor herself is a great follower of Jesus, she tells me so on Friday mornings when her and her compatriots knock on my door at O'dark 30.  I also am reminded daily of her faith by her dealer ring on her old beat up 1983 beetle bug, it simply states "The word of the day is Jesus, Spread the word".  I see now that all sins can be forgiven, even those of the Murderers, Rapists, Thieves, Corporate criminals, Politicians, Terrorists, Molesters, all the way down to the Adulterers, Liars, Fornicators and Drunks.  All that must be done is confess your sins and seek  forgiveness from God in the name of Jesus.  The location doesn't matter, the gallows, jail, divorce court or during a confessional with your preacher (aka your vessel to God).  Just that you give yourself unto Jesus is required.  So now as all of your jaws are on the floor, saying to yourself, when did Josh become a believer.  I'll tell you when.  I came to this epiphany when I realized the more souls that are saved, the less crowded Hell will be.  And since I have my heart, or rather Soul, set on going there, I want to make sure the population is as low as possible.  I plan on buying lotsa real estate and want there to be very low demand to keep prices low.  So you see, its a simple purpose, get everyone to Heaven so I can have some peace and quiet in Hell.  I just want to see Me, Jim Beam, Jack Daniels and a few great Scotsman there, this way the beverages will be Not of This World, also leave some strippers for a good after dinner show. A democracy, by definition, is the form of government where the people retain the top ruling authority. There are two forms of democracy generally recognized, one being direct democracy and the other a representative democracy. As we approach the upcoming elections in November, it is a good opportunity to look back at some of the problems inherent with democracy. We can also look at how the framers of the U.S. constitution attempted to address the failures encountered by previous democracies.&lt;br /&gt;Even though a democracy is designed to allow the people to rule themselves, this is likely to be the biggest problem with such a form of government. People by nature are greedy and self-motivated. In a democracy, the policies and laws reflect that of the majority's views, thus leaving the minority underrepresented. Another issue is that the people can be fooled or mislead causing events and policies that are contradictory to that of the "greater good". In a democracy there are vast numbers of individuals all with different needs, desires, and motivations. Those needs and desires can drive people to bond together with others of similar views causing the rise of factions. The presence of strong factions can greatly shift the power of a democracy to a select group of people.&lt;br /&gt;Throughout history, democracy has been attempted several times. The two significant examples of this are Athens, Greece about 2500 years ago and the Roman's about 2100 years ago. The Athenians practiced direct democracy, where all citizens had a direct involvement in policies and issues. A core problem with this was only about thirty percent of Athens population were citizens. The other seventy percent were women, slaves and foreigners. Thus thirty percent controlled all governing aspects of life for the whole. The Romans had a representative democracy, this was where people were elected by the citizens to make up the governing body called the Senate. Much like Athens not all people were citizens. The body that elected the representatives were made up of the land owners and wealthy merchants, as well as military heroes. In turn they elected those representatives who best reflected their owns wants and desires. Demagogues were prevalent and often gave rise to many problems. They would sway a few factions to their favor thus increasing their own political power. An issue that both of these civilizations faced was their size. Eventually they grew so large in population that keeping order over the whole and effectively representing the people was increasingly difficult. In places like England where a parliament was created, they retained a monarch who still had severe influence over the government. Often times the ruling authority made themselves immune to the laws which governed the people.&lt;br /&gt;After declaring their independence from Great Britain, the United States formed a confederation as a central governing body. This meant that the newly formed states were independent, and voluntarily allowed the central government to take on some minimal duties. Some of which were forming an army, making treaties and alliances, borrowing money from the people, and forming a postal system. However it didn't allow for other considerations which eventually lead to its demise. The confederation didn't allow the government to levy taxes making it near impossible to pay for the army. Also, it was not allowed to implement military quotas making it impossible to form a standing army. Although the central government could enter into treaties it had no power to enforce them as well as being unable to control foreign relations of the states. The government could pass laws but the states were left to enforce them at their own discretion. In order to enact any laws, Congress had to get nine states to approve it. Congress was not allowed to make changes to the Articles of Confederation without consent of all thirteen states. The central government had no authority to regulate commerce between the states. It also lacked a judiciary system so there was no way to resolve quarrels between states. Also, each state printed their own money and was able to tax goods from other states. This lead to inflation and unstable economies within the states. Finally there was no executive branch to help guide and coordinate the central governments actions.&lt;br /&gt;After the Articles of Confederation were deemed to be inadequate the thirteen states sent representatives to the Constitutional Convention. During this convention there were two plans proposed, the New Jersey plan and the Virginia Plan. Both of these plans had their benefits and problems, eventually Roger Sherman came up with the Great Compromise. It was the Great Compromise that set up the bicameral system of the House of Representatives and the Senate.&lt;br /&gt;This new system moved to solve the problem of ensuring the majority of the people were represented in government while still providing adequate presence of the minority. Also, the three-fifths compromise was introduced, allowing for slaves to be partially counted in the population. This was to avoid alienating the southern states where the use of slaves contributed greatly to their economies. The system of checks and balances was also created by having three separate but equal branches of the government. This was to ensure that no one branch would acquire an overwhelming power or influence over the others. Congress was left to pass the laws, the Executive was to enforce the laws, and the Judiciary was left the authority to review the laws. It was decided that federal laws were to be the highest law of the land. The central government was given the power to print a single form of money thus stabilizing inflation and trade. The new government retained the authority to raise a standing army but was now granted the power to levy taxes in order to maintain it. The federal government also assumed control over interstate commerce and could impose tariffs on foreign goods. One important part was the creation of the Bill of Rights, in these amendments, the individual was granted certain rights that are protected from infringement by the government. Finally the constitution gave the provision that anything not directly addressed in it was left to the states themselves to govern.&lt;br /&gt;At the time of its creation, our democracy was looked on by the world as what was going to be the next failed attempt at a people trying to govern themselves. Over the last couple of centuries our country has seen its share of successes and failures. But through it all, we have maintained our democracy and pushed ever forward. At no given time in history can a people foresee what the future holds. Our founding fathers did see though that future generations would be best served to be allowed to make decisions for themselves. I mean, really, really sucks.  I've never had a land line either, and so here in New Haven my cell phone is my Olive Branch.  One of the things I am most thankful for here is that I get 5 bars of service pretty much everywhere here. &lt;br /&gt;&lt;br /&gt;But no, not in Irvine.  The wonderful people of Irvine have decided that cell phone towers are ugly, and apparently have been kept to a bare minimum as some sort of a city beautification policy.&lt;br /&gt;&lt;br /&gt;Evidently they've never seen those picturesque cell phone towers disguised as a palm tree!  &lt;br /&gt;&lt;br /&gt;I'm being serious here.&lt;br /&gt;&lt;br /&gt;I think you're DEAD ON on your analysis.   In my mind, the price I pay for my service (letter 'a') should cover ALL the expenses necessary to providie the service to which I'm subscribing.  The additional $4.65 that allegedly cover "any additional costs associated with providing service" blah blah blah is ABSOLUTELY a rip-off, and its legality is the result of some carefully-placed loophole in California legislation.&lt;br /&gt;&lt;br /&gt;I'm truly, truly sorry you had to buy a landline.  Cell phone bills are a pretty big rip off to begin with, but their convenience (of being able to use one single line/number from anywhere) allows one to forego a landline. And you guessed it! The cell service in my new apartment is terrible! I have subsequently been forced to sell my soul to the devil and end my streak of avoiding any dealings with landline telephone providers and the absolutely ridiculous "taxes, fees, and surcharges" they so delicately apply to the monthly bill. And while I realize that we do suffer from great injustices every month when we receive our cell phone bills, they are far outweighed by the debauchery that I have discovered on my new landline bill.&lt;br /&gt;&lt;br /&gt;There are three key numbers that need to be considered in this discussion:&lt;br /&gt;&lt;br /&gt;a) $10.69&lt;br /&gt;b) $9.13&lt;br /&gt;c) 85.4 %.&lt;br /&gt;&lt;br /&gt;The number that is represented by the letter ‘a’ is the monthly phone charge that I agreed to pay AT&amp;amp;T in exchange for an almost useless and soon-to-be obsolete service. The number that is represented by the letter ‘b’ is the sum of the “taxes, fees, and surcharges” that warmed my heart upon opening my first bill. While I’m sure that the reader already realizes the significance of the third number, ‘c’, I would like to explicitly express my disgust with being charged over 85% in dubious “taxes, fees, and surcharges”. Below is a list of the questionable charges as they appeared on the bill.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;Surcharges and Other Fees&lt;br /&gt;&lt;/strong&gt;Federal Subscriber Line Charge $4.65&lt;br /&gt;Rate Surcharge $1.39&lt;br /&gt;State Regulatory Fee $0.06&lt;br /&gt;Federal Universal Service Fee $0.42&lt;br /&gt;&lt;strong&gt;Total Surcharges and Other Fees $6.52&lt;/strong&gt;&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;Government Fees and Taxes&lt;/strong&gt;&lt;br /&gt;CA High Cost Fund Surcharge – A: $0.10&lt;br /&gt;CA High Cost Fund Surcharge – B: $0.99&lt;br /&gt;California Teleconnect Fund Surcharge $0.06&lt;br /&gt;Universal Lifeline Telephone Service Surcharge $0.64&lt;br /&gt;CA Relay Service and Communications Devices Fund $0.03&lt;br /&gt;9-1-1 Emergency System $0.10&lt;br /&gt;Federal** $0.69&lt;br /&gt;&lt;strong&gt;Total Government Fees and Taxes $2.61&lt;/strong&gt;&lt;br /&gt;&lt;br /&gt;**Could it get any more vague!?!&lt;br /&gt;&lt;br /&gt;The above absurdity speaks for itself. While all of these charges (with the exception of the 9-1-1 Emergency System charge, which I’ll gladly pay) should warrant further investigation, most are too petty and ridiculous to justify consuming any amount of my time. But this is a problem in and of itself because the morons who invent these charges count on this kind of a response from the complacent masses. They know full well that most people will bend over and take it every month without giving a $0.03 charge a second thought. And even if we do give it a second thought, what the hell are we going to do about it? And therein lies the injustice. Is stealing any less stealing if the amount is three cents instead of three million dollars? No, three cents is simply less noticeable! But three cents a couple million times is quite a nice sum of money for a bunch of bureaucrats to spend on whatever wasteful expense they can conjure up.&lt;br /&gt;&lt;br /&gt;The one charge that especially caught my attention was the $4.65 Federal Subscriber Line Charge, which apparently is technically not a tax. The Federal Subscriber Line Charge simply “allows local telephone companies to cover some of the costs of providing telecommunications services to individual locations . . . the maximum charge is $5 per line per month”[1]. But since when do for-profit companies need government permission to charge the consumer enough to cover the cost of doing business? Sounds like Business 101 to me! They have taken the position that any &lt;br /&gt;&lt;br /&gt;'electric personal assistive mobility device ("EPAMD") that is self-balancing, has two non-tandem wheeled devices, is designed to transport only one person, and has an electric propulsion system that limits the maximum speed of the device to twelve and one-half (12.5) miles per hour or less'&lt;br /&gt;&lt;br /&gt;...is classified more-or-less like power wheelchair.  I wouldn't feel comfortable with a power wheelchair cruising down the street, either.  However, in California, I am allowed to ride on bike lanes.  I wonder if they have bike lanes in New Haven? He asked if I could spare some money so he could get some food.  It was about 12:30 in the afternoon and I had just finished eating.  I told him, “No, not today.”  I suppose I could have told him that Vons was hiring, or that there was a Help Wanted sign at Nick’s Burgers.  Go earn your own money.  That’s what I did.&lt;br /&gt;&lt;br /&gt;The great thing about the American Economy is that somewhere there is a job or everybody.  Regardless of how uninspired, unmotivated, or uneducated (heaven forbid!) one might be, somewhere somebody will want to accommodate that person.  Now, granted it might pay at minimum wage, it might involve checking septic systems for leaks, roofing a house in the August heat, or giving barium enemas to incontinent pachyderms (ehem, elephants)… but it’s something.  &lt;br /&gt;&lt;br /&gt;The problem is that there are TOO MANY JOBS.  We’ve all seen the movie “Office Space” of course.  The company hires a “consultant” (dun, dun, dun!) who promptly surveys the payroll and advises the boss to fire something like 30% of the company’s employees.  Everybody asks the boss, “Why am I being fired!?  What did I do!?”  The boss’s response: “I don’t know what you did.  That’s why you’re being fired.”&lt;br /&gt;&lt;br /&gt;Having too many jobs means too much pay, which means higher prices everywhere.  Look at the quagmire of insurance companies, especially those involved in medical insurance.  If everybody paid cash for their medical needs instead of going through insurance, doctors would be able to charge 40% less for their services and would make more money than they do now.  And imagine how much money we would save if state law did not require us to have auto insurance.&lt;br /&gt;&lt;br /&gt;Couldn’t we self-insure?  Would it be so difficult, if, say, we deposited $100 a month into a bank account called “My auto insurance” or “My Rx Benefits” instead of paying it to an insurance company?  You'd earn interest, too.  How often do you think you USE your auto insurance for your benefit?  Once a year?  Once every 5 years?  If you save conservatively at $100 per month to your bank account called “My auto insurance” then that entitles you to $1200 in damages per year.  Who causes that much damage to a vehicle every year?  If you do, for God’s sake, get off the road.  If you want to drive behind a BMW in a car with bad brakes but don’t have the money to fix a BMW bumper, then please, fix your brakes or at least change lanes.  Oh, and get off your cell phone.&lt;br /&gt;&lt;br /&gt;Yes, yes, I know, I’m a flaming libertarian. Our employer should fire us.&lt;br /&gt;&lt;br /&gt;If our employer does not pay us at a level equal to our skills, knowledge and production, they are not ethical. We should fire them.&lt;br /&gt;&lt;br /&gt;If we demand compensation above our skills, knowledge and production then we are unethical. Time on the job does not warrant compensation by itself, unless our experience gained by time on the job benefits the organization through better production.&lt;br /&gt;&lt;br /&gt;In a larger sense, if we are not ethical, we introduce chaos into our social system. In a chaotic system, those who are the cruelest thrive. The cruel and power hungry dominate and enslave those around them. Therefore, in the interest of self-preservation, unless we are one of the cruel, we must be ethical to protect ourselves and those we care for.&lt;br /&gt;&lt;br /&gt;It is frightening to realize that there is a tipping point at which the amount of non-ethical behavior overwhelms the system’s ability to compensate and chaos predominates.&lt;br /&gt;&lt;br /&gt;We each know in our heart what is ethical and what is not, only the scholars are uncertain. A full copy of the report can be obtained using the link below. - The Chemist&lt;br /&gt;_____________________________&lt;br /&gt;&lt;br /&gt;Analysis of the latest Census data indicates that California's illegal immigrant population is costing the state's taxpayers more than $10.5 billion per year for education, medical care and incarceration. Even if the estimated tax contributions of illegal immigrant workers are subtracted, net outlays still amount to nearly $9 billion per year. The annual fiscal burden from those three areas of state expenditures amounts to about $1,183 per household headed by a native-born resident.&lt;br /&gt;&lt;br /&gt;This analysis looks specifically at the costs to the state for education, health care and incarceration resulting from illegal immigration. These three are the largest cost areas, and they are the same three areas analyzed in a 1994 study conducted by the Urban Institute, which provides a useful baseline for comparison ten years later. Other studies have been conducted in the interim, showing trends that support the conclusions of this report.&lt;br /&gt;&lt;br /&gt;As this report will note, other significant costs associated with illegal immigration exist and should be taken into account by federal and state officials. But, even without accounting for all of the numerous areas in which costs associated with illegal immigration are being incurred by California taxpayers, the programs analyzed in this study indicate that the burden is substantial and that the costs are rapidly increasing.&lt;br /&gt;&lt;br /&gt;The more than $10.1 billion in costs incurred by California taxpayers is composed of outlays in the following areas:&lt;br /&gt;&lt;ul&gt;&lt;li&gt;&lt;strong&gt;Education:&lt;/strong&gt; Based on estimates of the illegal immigrant population in California and documented costs of K-12 schooling, Californians spend approximately $7.7 billion annually on education for illegal immigrant children and for their U.S.-born siblings. Nearly 15 percent of the K-12 public school students in California are children of illegal aliens.&lt;br /&gt;&lt;/li&gt;&lt;li&gt;&lt;strong&gt;Health care: &lt;/strong&gt;Uncompensated medical outlays for health care provided to the state's illegal alien population amount to about $1.4 billion a year. &lt;/li&gt;&lt;br /&gt;&lt;li&gt;&lt;strong&gt;Incarceration:&lt;/strong&gt; The cost of incarcerating illegal aliens in California's prisons and jails amounts to about $1.4 billion a year (not including related law enforcement and judicial expenditures or the monetary costs of the crimes that led to their incarceration).&lt;/li&gt;&lt;/ul&gt;State and local taxes paid by the unauthorized immigrant population go toward offsetting these costs, but they do not come near to matching the expenses. The total of such payments can generously be estimated at about $1.6 billion per year.&lt;br /&gt;&lt;br /&gt;The fiscal costs of illegal immigration do not end with these three major cost areas. The total costs of illegal immigration to the state's taxpayers would be considerably higher if other cost areas such as special English instruction, school feeding programs, or welfare benefits for American workers displaced by illegal alien workers were added into the equation.&lt;br /&gt;&lt;br /&gt;While the primary responsibility for combating illegal immigration rests with the federal government, there are many measures that state and local governments can take to combat the problem. Californians should not be expected to assume this already large and growing burden from illegal immigration simply because businesses or other special interests benefit from being able to employ lower cost workers. The state must adopt measures to systematically collect information on illegal alien use of taxpayer-funded services and on where they are employed. Policies could then be pursued to hold employers financially accountable.&lt;br /&gt;&lt;br /&gt;The state could also enter into a cooperative agreement with the federal government for training local law enforcement personnel in immigration law so that illegal immigrants apprehended for criminal activities may be turned over to immigration authorities for removal from the country. I think that your side of the argument would go a lot further with the people on the fence on this issue if you would just acknowledge that the only immigration that ANYONE wants to curb is the illegal kind. Is it unreasonable for a democratically elected legislative body to make laws that are in the best interest of the safety of its citizens? Is it unreasonable for an executive branch of government to try to enforce its laws? If you say it is, then I must ask, why do we even bother with governments? And you can't really be against a more organized, more efficient immigration system that facilitates the citizenship process and saves thousands of lives by preventing people from trying to swim across rivers and hike through deserts led by unscrupulous Coyotes.&lt;br /&gt;&lt;br /&gt;There is room for debate here, but only if we all remain candid and truthful about the real situation. We must have clarity if this issue is ever to be resolved, to the benefit of all parties. I do realize that it has the potential to make 12 million undocumented workers, citizens. Yet, there are still consequences such as fines of $2,000 (which is nearly impossible to pay for these low-wage workers), backed taxes, a background check, and having to learnEnglishh. That would be kind of odd for a country that doesn't really have an "official" language.I support undocumented workers becoming citizens, but I do not support some of the other implementations. First of all, this bill would create 700 miles of extra fence on the U.S. Mexican border. This would then be the third wall that the United States has put up. Since the the last wall was put up through Operation Gatekeeper, over 500 undocumented workers have died. This system is NOT working.Lastly, this bill would cause for a guest worker program. Which is like teasing a baby with candy. You can touch it, feel it, see it, but you can't have it. This would make guest workers second class citizens. Racism would rise like no other.In your email you capitalized ILLEGAL. I would just like to acknowledge that this country was built off of immigration. Immigration runs this country. On top of all of this, this land was stolen. East coast was stolen from Native Americans and the west coast stolen from the Mexicans. And you can't really think that a background check is unreasonable. Do you? And learning English is not punishment. Can you really say that immigrants would be damaged by becoming bilingual? Learning English is a positive thing! Just like it is a positive thing for any person to learn any language different from his native tongue. Learning new languages stimulates the brain, which every college student, by definition, should support.&lt;br /&gt;&lt;br /&gt;On the issue of legal and illegal:&lt;br /&gt;&lt;br /&gt;First you wrote, "Immigration runs this country", and you're right! But every immigrant who came here after the establishment of the federal and state governments was required to register and assimilate. That is what my great grandparents did (from Italy and Ireland) and that is what immigrants should still do.&lt;/span&gt;&lt;br /&gt;&lt;span style="font-family:times new roman;"&gt;&lt;br /&gt;Then you wrote, "On top of all of this, this land was stolen." Yes, this country was established through force. No one can deny that this is the case, but so what? Nearly every civilization in the history of mankind has been established by force, including Mexico. The Native American tribes fought amongst themselves for control over the land for years before Europeans ever got here. War is what shapes a nation's boarders, whether you like it or not. That's reality. War is how the U.S. gained independence from England and war is how Mexico gained its independence from Spain. The following excerpt is taken from the History channel website at&lt;br /&gt;&lt;br /&gt;&lt;/span&gt;&lt;a href="http://www.historychannel.com/exhibits/mexico/?page=independence"&gt;&lt;span style="font-family:times new roman;"&gt;http://www.historychannel.com/exhibits/mexico/?page=independence&lt;/span&gt;&lt;/a&gt;&lt;br /&gt;&lt;span style="font-family:times new roman;"&gt;"Under the terms of the Treaty of Guadalupe Hidalgo on Feb. 2, 1848, the Rio Grande was fixed as the boundary of Texas and the territory now forming the states of California and New Mexico became part of the U.S. The Gadsden Purchase in 1853 clarified the New Mexico boundary and gave an additional strip of territory (now southern Arizona and a slice of southwestern New Mexico) to the U.S."&lt;br /&gt;&lt;br /&gt;Some of the territory was won in war and the rest was purchased. Whether you agree with how it was established or not you must acknowledge the 150 year old agreements made between the U.S. and Mexico. The U.S. recognizes the legitimacy of the Mexican government. Why should Mexico not recognize the U.S.? So when you say, "what most Mexican immigrants are coming back to is their own land of Aztlan", you're wrong. The land does not belong to Mexico and hasn't for the last 150 years. And in that case, no living U.S. citizen stole anything from any Mexican and no living Mexican was robbed of any land.&lt;/span&gt;&lt;br /&gt;&lt;span style="font-family:times new roman;"&gt;&lt;br /&gt;I will just say one last thing. People immigrate to the U.S. because it is a nice place to live. We have a strong economy and are the wealthiest and most prosperous nation on earth. This is largely because of the freedom we enjoy and the form of government under which we live. This didn't happen overnight, it wasn't an accident, and it didn't have anything to do with the land that was "stolen" from Mexico. "Aztlan" is the way it is today because of the fact that it is part of the United State of America. If it weren't, it would be under the control of the undeniably corrupt Mexican government and would no doubt resemble Tijuana more than any city in the U.S. Mexicans have not been victimized by the U.S., they have been victimized by their own government. It's a little long, but bear with me please, and let me know what you think.&lt;br /&gt;&lt;br /&gt;I'm moving to New Haven, CT, in mid-August.  Because I have some trouble walking and have opted to leave my beloved BMW Z3 in California to avoid its getting rusted out by the snow-and-salt winters of the eastern seaboard, I dug deep into my pockets and bought a Segway.&lt;br /&gt;&lt;br /&gt;HOWEVER!!!  The city of New Haven has disallowed the Segway on all streets and sidewalks.  The streets and sidewalks on the Yale University campus are governed by the city, so the Segway is disallowed on the campus as well.  &lt;br /&gt;&lt;br /&gt;Why would they do this?  I argue.  The Segway is electrically powered, self-balancing, requires no maintainance, and costs less over the course of 5 years then a cell phone.  (About $0.20 per mile.)&lt;br /&gt;&lt;br /&gt;The first thought is bureaucracy, of course, and then, safety.  BUT... read on.&lt;br /&gt;&lt;br /&gt;The Segway is classified by the Federal government as a consumer product, not a motor vehicle, and is not a wheelchair. Prior to its introduction, the only practical mobility devices that were available to people with disabilities, or those who have difficulty walking, required them to be seated in order to operate them.  On the contrary, the Segway allows the user to stand.  Americans with Disabilities Act (ADA) guidance, issued by the United States Department of Transportation on September 1, 2005, correctly identified the Segway, when used by a person with a disability, as a mobility device that is part of a broad class of mobility aids occupying a legal position analogous to canes, walkers, etc.   The Segway is therefore fully protected as an assistive device as defined by the United States Congress, which defined an assistive technology device in "The Rehabilitation Act Amendments of 1973, As Amended" as "any item, piece of equipment, or product system, whether acquired commercially, modified, or customized, that is used to increase, maintain, or improve functional capabilities of individuals with disabilities.”&lt;br /&gt;&lt;br /&gt;From a post on the DRAFT (Disability Rights Advocates for Technology, www.draft.cc): "the Segway’s use is fully protected by the Americans with Disabilities Act of 1990. Public Law 101-336."  --I believe that my disability is a qualifying disability under the ADA, in that my disability is a physical impairment that substantially limits one or more of the major life activities; in my instance, walking--  "Furthermore, failure to allow the use of a Segway by a person with a qualifying disability is a violation of Federal law. The United States Department of Justice has substantial enforcement responsibilities under Title III. 42 U.S.C. 12188(b). Civil penalties and civil actions are possible."&lt;br /&gt;&lt;br /&gt;In the three years since its introduction to the general public in 2003 there are no reports of any substantive injuries being caused to bystanders from those using the Segway.  The design of the Segway actually precludes it from continuing forward once it comes in contact with something, and the tires are designed in such a fashion that running over someone's foot or hand causes no injury. The same could not be said about a power wheelchair or scooter.  Moreover, the Segway weighs a fraction of other mobility devices, and its stopping distance, in comparison to other mobility devices in a test by the Federal Highway Administration, was second only to that of a manual wheelchair.&lt;br /&gt;&lt;br /&gt;A study done by the Victoria Transport Policy Institute, which compared the safety of the Segway to that of other mobility devices, was presented at the Transportation Research Board's Annual Meeting in January of 2004 in Washington, DC. In assessing the relative safety of the Segway and its risk to others, the report suggests the Segway represents a risk to others that is consistent with that when children are playing nearby, even when operated at top speeds.  Comparatively, the report indicates that motor or powered wheelchairs or scooters represent a medium to high risk to others.  &lt;br /&gt;&lt;br /&gt;The issue of forcing a disabled person who has the ability to stand but has difficulty walking, like myself, and requires a mobility aid, to sit in either a wheelchair or a scooter, IS UNREASONABLE AND UNLAWFUL!&lt;br /&gt;&lt;br /&gt;I have been in brief contact with the ADA Coordinator of the city of New Haven, Michelle Duprey, requesting a Title II Letter of Accommodation.
